The Terms of Service page is under heavy construction. If you have any questions, please contact us. Much of what's in here is from our old website, so it's getting an update. When everything is finished, we'll make an announcement to keep all current users up to date. We thank you for your patience. General Terms

 A. Acceptance of Terms

  1. To use GMA Group services, you must accept the terms.
  2. The following actions constitute an acceptance of the terms.
    a. Creating an account on our website(s).
    b. Making a purchase on our website(s).
    c. Clicking on any acceptance buttons of the terms provided to you by us.
    d. Signing any documents provided to you by us which outlines the terms.
  3. Accepting the terms also requires acceptance of our Privacy Policy and AUP Policy.
  4. Acceptance of the terms are on an individual basis. You may not accept the terms on behalf of an entity unless the entity is willing to be liable for all individual actions acting on behalf of the entity.

 B. Universal Terms

  1. These terms will serve as the minimum for any policies on our website(s) when our websites don't have specific terms on them. You must consider these terms as the "Universal Terms".
  2. Most of our websites link to this page, therefore these terms act as the terms for those websites as well. These terms may be supplemented with additional terms on the specific website(s) owned by us.
  3. Terms located on the website(s) owned by us shall take precedence unless terms are not provided for certain situations, in which case these terms shall take precedence.
  4. You may not accept these terms or use our services if you are not of legal age to form a binding contract, or if you are banned from receiving services in the United States.
  5. You are encouraged to print, copy or bookmark this page for reference, but you may not modify or redistribute these terms without permission, even for personal use.

 C. Language of The Terms

  1. The official language of the terms is English.
  2. If you do not speak English,
    a. You are responsible for providing an interpreter or...
    b. You must learn English to be able to understand the terms or...
    c. You may not use our services.
  3. If you use our services at the same time while not understanding English and you violate our terms, then you are responsible for all consequences even if you do not understand our terms. We are still not required to provide an interpreter, you may be required to hire one at your own expense.
  4. We are not responsible for any misinterpretations by your interpreter / translator.

 D. Your Relationship With The GMA Group

  1. By accepting these terms, you are signing into a binding contract, a nonexclusive relationship between you and The GMA Group.
  2. Your contract with us shall be in effect until terminated by both parties.

Changes To Terms

Notices will be considered given and effective on the date posted on our website. These changes will become binding and effective the date they are posted to our website. No further notice by us is required upon your continued use of the Service. The Agreement as and when posted supersedes all previously agreed to electronic and written terms of service. The dates of the updated terms will be posted at the bottom.

    a. The adult is considered the responsible individual and must supervise all actions.
    b. When not being supervised, the adult is still responsible for the individual's actions.
  3. Individuals 13 and under may not use our services for any reason.
    a. We do not knowingly, nor willingly collect personal information of minors.
    b. We do not knowingly, nor willingly allow kids to register on our website(s).
    c. We do not knowingly, nor willingly provide services to children.
    d. Individuals found to be 13 and under will automatically be suspended.

5. Accounts, Account Security and Passwords

5.1 You agree and understand that you are entitled to one (1) account per IP address, and multiple accounts will result in suspension of all but the first account, unless abuse is detected, in which case all associated accounts will be suspended regardless of service purchased. Refunds for this form of abuse will be at the discretion of Ascii Altar.
5.2 You agree and understand that you are solely responsible for any and all activities occurring on your account.

5.3 You agree and understand that each service is bound to the account it is purchased with.

5.4 You agree and understand that you are solely responsible for the confidentiality and the protection of your passwords associated with your account you use to subscribe / purchase services at Ascii Altar.

5.5 You agree and understand that should you need to share an account with another individual, you will submit a ticket requesting this and wait for a response from a team member of Ascii Altar. You assume all responsibility regardless of who is on your account.

5.6 You agree and understand that if you are aware of any security issues associated with your account, or if you suspect unauthorized access of your account, you will notify Ascii Altar immediately. In addition to notifying Ascii Altar, you will change the passwords of your account immediately, especially the passwords of subscribed services.

Section 2 - Hosting Services

1. Your Account

1.1 Account setup for hosting involves first registering an account at Ascii Altar. By simply registering, you are not setting up a hosting account, this account is used as a global profile for Ascii Altar. You may setup hosting at anytime with Ascii Altar by clicking the "My Account" link, and from there by clicking on "Manage Hosting" within the account menu. Your hosting account and Ascii Altar account is not linked for security reasons, and you should have different usernames and passwords for both, although you will not be able to access hosting without logging into Ascii Altar's primary website first. YOU are responsible for remembering both your accounts' information.
1.2 To setup and maintain hosting, you must meet the following conditions,

(a). All your contact information is kept up to date;
(b). The account you're using currently does not use the same email as the one you wish to use for your hosting service;
(c). You have not previously committed fraud using another hosting service;
(d). You have not previously committed fraud in any other manner;
(e). You abide by the Terms of Ascii Altar.

1.3 If there is abuse that occurs on your account, or we need to contact you regarding your account, you need to have up to date contact information. IT IS YOUR RESPONSIBILITY TO MAINTAIN YOUR CONTACT INFORMATION. NOT KEEPING YOUR CONTACT INFORMATION UP TO DATE MAY RESULT IN THE TERMINATION OF YOUR ACCOUNT WITHOUT NOTICE. IF YOU DO NOT RECEIVE NOTICES, OR IF WE'VE TRIED TO CONTACT YOU AND YOU HAVE NOT RECEIVED OUR NOTICES, THEN YOU HAVE SUPPLIED INCORRECT INFORMATION. WITHOUT CORRECT CONTACT INFORMATION, YOU WILL NOT RECEIVE IMPORTANT NOTICES OR NOTICES OF TERMINATION, IN WHICH CASE WE CANNOT BE HELD LIABLE FOR ANY DAMAGES THAT OCCUR OUT OF YOUR LACK OF MAINTAINING YOUR CONTACT INFORMATION. WE WILL DO OUR BEST TO CONTACT YOU IN ANY SITUATION, HOWEVER IT MUST BE STRESSED THAT IT IS YOUR SOLE RESPONSIBILITY TO KEEP YOUR ACCOUNT'S CONTACT INFORMATION UP TO DATE AND ACCURATE.

1.4 If you are purchasing high risk services such as a dedicated server or hosting management, we need to verify several things in order to process your transaction. You may be required to provide identification for valuable services that exceed a value determined by Ascii Altar. You may also be subject to a credit check. We will contact you with what information we need if necessary, or if you have successfully gone through a high risk transaction, we may later verify your information with your permission. If you deny the verification process, your transaction may be considered fraudulent and potentially denied.

2. Transfers

2.1 If you need help transferring, our team will make every effort to move your website from your current host to us. This service is provided as a courtesy, and your website is not guaranteed to work on our system configuration as your previous host's configuration could be vastly different from ours. No host is configured the same way, and we do not encourage moving between different systems, but if you're sure about transferring, then we'll do what we can. Again, we'll do our best and it is not guaranteed that transferring will be a success. Transfers must be done within 30 days after making a hosting purchase.
2.2 There's a limit of 50MB per database and 500MB total compressed file size. Please provide instructions on how to restore databases if you're using a specific script. The following will list your options for transfers,

(a). File Packup and Database Download: Compress and download all your files, compress and download all your databases, send them to us either through email or through an upload tool we provide you.
(b). cPanel Access: Grant us permission to access your current cPanel account and we'll do the rest from there. Point your domains to our servers after we've notified you of the transfer completion and you're good to go.
(c). Do It Yourself: We'll provide you with cPanel login information after you've made a subscription purchase. You don't need to point your domains to our servers until you're satisfied with the transfer.

3. Hosting Account Usage

3.1 Ascii Altar services, hardware, and all related equipment, networks and network devices, resources and virtual resources are intended for authorized use only.
3.2 Ascii Altar reserves the right to refuse service to anyone. We reserve the right to prohibit what types of content may be stored on our servers. Any content or material found on our servers that is in our judgement deemed inappropriate, obscene, illegal, threatening, or violates our terms of service in any way will be removed from our servers with or without notice, and accounts potentially suspended.

3.3 Ascii Altar periodically monitors accounts to ensure accounts are being used for lawful purposes. By signing up for an account, you are agreeing and consenting to these screenings. We monitor accounts for several other reasons including, but not limited to verifying security, checking against unauthorized access, verifying operational systems, and management of systems. During this process, information may be examined, tested, recorded, copied and archived for authorized purposes.

3.4 You are not permitted to connect to third party systems or networks without consent of the owners or without authentication. Failure to comply with this regulation is grounds for instant termination. We may from time to time request proof that you are authorized to connect to such third parties or networks.

3.5 We cannot monitor all content that goes against Section 230(c) The Communications Decency Act at times, and therefore we leave the decision to the courts when content is deemed inappropriate for the internet. We provide a platform where users can publish their content online, and users are solely responsible for what they post. We cannot be held liable for any offensive, harassing or defamatory content, and any websites with such content will be left to the justification of the courts, At a court's decision request, we will comply fully.

3.6 You understand that it is your responsibility to maintain secure scripts. Set directory and file permissions accordingly. You are responsible for all actions taken on your account. Ascii Altar will not be held responsible for compromise of accounts due to security negligence.

3.7 We send out emails to account owners that are in violation of our guidelines. Failure to respond to such emails within 48 hours will result in the immediate suspension and termination of all accounts associated with the accounts owner.

3.8 UNDER NO CIRCUMSTANCES WILL YOU UPLOAD OR LINK TO CHILD PORNOGRAPHY OR POST CONTENT SIMILAR TO OR RESEMBLING CHILD PORNOGRAPHY (LOLITA). ANY SITES FOUND TO BE PARTICIPATING IN SUCH SITUATIONS WILL BE FLAGGED AND TERMINATED AND REPORTED TO AUTHORITIES. HARM TO MINORS IS STRICTLY PROHIBITED AND WILL NOT BE TOLERATED.

3.9 If you are in doubt regarding your site's content and it's acceptability, contact us and we'll commence with an investigation of your website.

3.10 For resellers, you agree to respect, honor and accept the guidelines provided above. If you do not comply with the guidelines above, your account will be terminated without notice.

4. Content

4.1 You may use Ascii Altar services for lawful purposes only. The laws of Pennsylvania, and the United States of America apply. Customers of Ascii Altar services agree to indemnify and hold harmless Ascii Altar from any claims that may result from the use of our services.
4.2 You may not use our services to infringe upon any copyrights or trademarks. This includes, but is not limited to: Unauthorized replication, distribution, sale, or sharing of content such as music, books, software, virtual goods, photographs, videos, or other protected work. You may not offer the sale of counterfeit merchandise of a trademarked or copyrighted product. Accounts found in violation of these terms will be suspended, or denied access without notice, as well as all associated accounts without compensation of service fees, administrative fees, and any fees associated with the accounts suspended.

4.3 The following only applies to shared hosting plans: You may not use your account as a backup / storage service unless it clearly states it in your service agreement. You are permitted to have one (1) copy of your entire cPanel / FTP / Hosting account stored for a duration of seven (7) days total, after which it must be downloaded and removed or replaced with a fresh copy. This is allowed for purposes of securing your website(s) incase of disaster or you need to revert to a backup quickly. Additionally to the previous statement, you are permitted up to your allowed disk space unlimited backups for a duration of twenty four (24) hours, after which all backups must be downloaded and removed from your account.

4.4 The following are unacceptable use / content with all shared hosting plans,

(a). Sites that condone or endorse or promote illegal activity;
(b). Sites that are hateful, racist and / or harassing;
(c). Sites that focus on hacking, cracking and unauthorized accessing;
(d). Sites that contain pirated software / warez;
(e). Sites / Forums that share / distribute or link to pirated software, warez, and illegal content;
(f). Engaging in the sales of controlled substances without proof of a license / permit;
(g). Sites intended to deceive a visitor into engaging in fraud;
(h). Fraud Websites (Sites listed at aa419.org, escrow-fraud.com, etcetera);
(i). Proxy Scripts / Anonymizers, IP Masking Service;
(j). IP Scanners, Privacy Invasion;
(k). IRC Scripts & Bots;
(l). Server Sided Chat Scripts / Automatic Refresh Chat Scripts;
(m). Bruteforce Programs (High CPU and Memory Scripts / Applications);
(n). Scripts that run for long periods of time without user activation;
(o). Scripts that take advantage of system resources / hog system resources;
(p). Mail Bombing (Mail Bombers / Spamming Scripts);
(q). Heavy Emailing Scripts (Mailer Pro, Mass Email Scripts);
(r). File Sharing / Mirror Sites (Similar to Rapid Share);
(s). Banner Rotation, Advertising Services, Affiliate Link Services;
(t). Web Hosting Scripts (Such as Guild Hosting, Wordpress Multisite/MU);
(u). Image Hosting Scripts (Similar to Photobucket, Tinypic, Imageshack);
(v). Selling part of your subscription service to another individual;
(w). Offering your subscription service as a shared free / paid hosting service;
(x). Top Sites (Vote to Enter, Website Rankings);
(y). Auto Surfing (Pay To Click / Pay To Surf / Pay Per Click sites);
(z). Lottery & Gambling Sites;
(aa). Game Servers (MUDs / RPGs / MMORPGs / BBGs / PBBGs);
(ab). Streaming similar to YouTube, Megavideo, Hulu;
(ac). Live streaming using your shared hosting account to stream content;
(ad). Virtual investment sites, online investment sites (Including, but not limited to Second Life, Ponzi, Pyramid Schemes, FOREX, E-Gold Exchange);
(ae). Online loan services, loan sharking, bank debentures;
(af). High yield interest programs, high interest paying programs;
(ag). Online banking services;
(ah). Debt trading;

5. Resellers

5.1 You agree that you are solely responsible for supporting your clients. Ascii Altar will not provide support to customers who hold an account on your reseller plan.
5.2 You agree that you are responsible for all content stored on your reseller account by your clients. This includes all of our content policies, as well as yours.

5.3 You agree that all your clients will be bound by the same guidelines found in the Ascii Altar terms of service for resource usage.

6. No Tolerance Spam Policy

6.1 We do not tolerate spam in any way, manner, method or form. Bulk emailing, Unsolicited E-Mail, Spam, Lists, "Safe Lists", all will be treated as spam. We do allow for email list building and mailing specifically to that list, but only if your customers have specifically expressed desire to be on those lists. Proof may be required from time to time when sending bulk emails. For "Legitimate" lists, we allow up to 250 emails to be sent out one (1) time per day. If you need to send more emails at once, you should consider a bulk emailing service. We will always investigate bulk emails, and any found to be spam will result in the source account's termination without notice.
6.2 We do not host websites that are advertised with spam. If your domains are on our servers and have been advertised through any means of spam, your account will be instantly terminated without notice. Spam advertising includes, but not limited to phone, email, fax, paid for directory listings, and instant messaging. Any damages resulting from spam advertised websites will incur a fee "RECOVERY FEE" for getting our IP addresses unblacklisted. For resellers, YOU ARE RESPONSIBLE FOR MAINTAINING CLEAN IP ADDRESSES, AND ANY DAMAGES THAT RESULT FROM YOUR HOSTING SERVICES WILL BE YOUR RESPONSIBILITY, INCLUDING FEES FOR BLACKLIST REMOVAL. YOU ARE RESPONSIBLE FOR COLLECTING FEES FROM ABUSIVE ACCOUNT HOLDERS USING YOUR HOSTING SERVICE. Ascii Altar reserves the right to disable any website that does not comply with it's policies, or to make modifications at anytime to websites that do not comply with it's policies.

7. System Resource Usage

7.1 We're very lenient on resource usage for shared hosting plans compared to many other hosts, but we still require customers to maintain optimized websites to ensure fair resource availability for other customers. Optimization may include, but is not limited to caching, page compression, gzipping, optimized scripts, and low php execution times.
7.2 CPU usage guidelines are as follows,

In addition to the CPU table for max execution time of scripts, your account may not exceed a daily limit of overall server resources. This is a combination of all your account's processes and calculated at the end of the day.

Basic 2 10% of 1 Core (2.4GHz) = 240MHz
Basic 3 15% of 1 Core (2.4GHz) = 360MHz
Pro 1 25% of 1 Core (2.4GHz) = 600MHz
Pro 2 30% of 1 Core (2.4GHz) = 720MHz
Pro 3 35% of 1 Core (2.4GHz) = 840MHz
Webmaster 1 40% of 1 Core (2.4GHz) = 960MHz
Webmaster 2 50% of 1 Core (2.4GHz) = 1200MHz
Our servers are cloud based, so your resource usage is distributed over several servers. You may be on a cloud with 4.2GHz, or one with 10GHz. Regardless of which server you are on, we do not oversell.

In most cases, we will overlook slight overages, but this is at the discretion of Ascii Altar. When we release a new server, we'll allow overages when permission is requested until there're more clients on the shared server, in which case we'll resume with normal policy. Number of clients on a server may be requested through the ticketing system.

If you are using more resources than allocated for your account, it is suggested you upgrade. If you are at the maximum upgrade, then the only solution for you would be a VPS or Dedicated Server.

7.3 In addition to CPU usage, you may not

(a). Run cron in intervals of less than 30 minutes, or 15 minutes with permission;
(b). Run MySQL queries that take longer than 10 seconds, indexing is important;
(c). Use https for every page request. Try to only use https when absolutely necessary;
(d). Participate in file sharing / peer-to-peer / file distribution network activities;
(e). Run IRC clients or any software that interfaces with an IRC client (Internet Relay Chat);
(f). Run stand alone unattended server sided processes at any time, this doesn't include Cron;
(g). Run any type of web spider or indexer;
(h). Run any type of bit torrent trackers, clients, or applications. Linking to legal torrent files is alright, but torrents may not be tracked or hosted on shared servers;
(i). Run any type of gaming server including such as, but not limited to MUDs, MMORPGs, Browser Games, Private Servers, Half Life, and Counter Strike;
(j). (Optional Courtesy) Don't include a local file with an http request, instead use a local include method;
(k). (Optional Courtesy) Don't force html to handle server-sided code like php and shtml;

7.4 Each month, you are allotted a certain amount of bandwidth. If you go over the monthly limit, your account will be temporarily suspended. If you continuously go over your monthly limit, you are suggested to upgrade to a more powerful plan, or upgrade your monthly bandwidth limits if available.

7.5 INODEs are restricted by a simple formula. MB x 300 = INODE limit. Each file, web page, email, image, anything that creates a file on your account will use up one of your INODEs. We do not have a fixed limit of INODEs per account. The more disk space you have, the more INODEs will be available for your use.

Example 1: You have a plan with 50MB Disk Space, therefore you have 50MB x 300 = 15,000 INODES.
Example 2: You have a plan with 2,500MB Disk Space, therefore you have 2,500MB x 300 = 750,000 INODES.

It's very difficult to hit your INODE limit, and reaching the limit usually occurs when an individual abuses their account, or accidents happen and you weren't aware such as getting a massive wave of emails to one of your email inboxes, and you haven't retrieved them from the server yet.

Accounts cannot go over the INODE limits, therefore we do not suspend for such situations because they don't happen.

7.6 The size of your databases may not exceed a certain limit. This limit is determined by how much disk space is allowed on your account. The calculation is MB x 0.10 = Database Size limit per database.

Example 1: 250MB x .10 = 25MB Per Database.
Example 1: 1,000MB x .10 = 100MB Per Database.
Example 1: 2,500MB x .10 = 250MB Per Database.

8. Backups

8.1 You agree that your use of Ascii Altar services is at your sole risk. You are required to maintain backups of all your files (databases, public_html folder, everything associated with your account). Ascii Altar may from time to time create backups whether automated or manually, this is provided as a courtesy and should not be considered reliable. Ascii Altar is not responsible for loss of files associated with your account. You agree to assume all responsibility of your files and data and to create backups of your files on a regular basis.
8.2 You are permitted to have one (1) copy of your entire cPanel / FTP / Hosting account stored for a duration of seven (7) days total, after which it must be downloaded and removed or replaced with a fresh copy. This is allowed for purposes of securing your website(s) incase of disaster or you need to revert to a backup quickly. Additionally to the previous statement, you are permitted up to your allowed disk space unlimited backups for a duration of twenty four (24) hours, after which all backups must be downloaded and removed from your account.

8.3 Accounts nearing their disk space threshold may be sent notices to increase / upgrade disk space. This is optional, and you are at no obligation to upgrade. You will not be forced to upgrade, and notices are sent as a courtesy which may benefit users since reaching maximum disk space may result in loss of data. You agree to not rely on these notices and you will maintain up to date knowledge on your disk space usage. You agree to not hold Ascii Altar responsible for loss of data if you have reached your disk space threshold.

4. Ascii Altar Services Provisions

4.1 Ascii Altar is constantly trying to improve services, look, feel, and user experience for the betterment of the company. You agree that Ascii Altar may change anything regarding the website, services, and anything regarding Ascii Altar without prior notice.
4.2 In addition to the above statement, you acknowledge that Ascii Altar may stop, cease, delay, or temporarily suspend any service. If you are using a free service, you also acknowledge that no notice is due to you, and if you are using a paid service, you agree to frequently visit the website for notifications of services.

(a). If you wish to cancel a free service, no notice is necessary. Simply stop using that service.
(b). If you wish to cancel a paid service, cancellation is required, or guidelines will be provided for you to cancel your service upon purchasing a service, or if no guidelines are provided, read our cancellation / refund policy.

4.3 You agree that if you cancel a service, you will no longer be able to access content on that cancelled service. If your service is cancelled by Ascii Altar, data may be available depending on the service. Additionally, if your service is cancelled by Ascii Altar, you will submit an inquiry regarding the reasons service was cancelled if you wish to dispute the cancelled service.

4.4 You agree that although some services do not have fixed limits, Ascii Altar may set limits for unfixed limit services.

Payments

3. Payments

3.1 You understand that it is your responsibility to maintain up to date payment information. You agree to provide accurate and up to date payment information upon account signup and during account maintenance. You understand and agree that if you decide to cancel a service, you will notify Ascii Altar of your desire to end services. You understand and agree that if you do not cancel a subscription, it will continue to bill on a monthly basis or a term basis in which you've selected upon subscription signup. Cancellations must be done through our ticketing system or through provided forms, which is why it's important for you to not share your account with any individual. Once we have received notice, it will take 2-4 days to process, and confirmation will be sent through email which must be confirmed by the individual wishing to end services. It is the customer's responsibility to create backups of all files prior to service cancellation, and Ascii Altar will not be held liable for loss of data.
3.2 You understand and agree that if your payments are late by seven (7) days, this will be considered a form of service cancellation. You may make a payment to reactivate services or simply do nothing and your subscription based service will be closed. This applies to all hosting packages and monthly subscriptions.

1.1 Ascii Altar will inform customers through either email or website notices of price changes. You understand and agree to check the website and your email once a month for such notices regarding price changes. Ascii Altar will give a minimum of 3 months notice prior to price changes of any subscription based plans.
1.2 You agree that if there is ever a price change for any subscription plan in which you are subscribing to, you will resume services with the new price or discontinue use of services.

 

Coupon Policy

2. Coupon Codes

2.1 You understand and accept that coupon codes for subscription based services are limited to one per client per lifetime.
2.2 You understand and agree that some coupons are not intended for recurring costs. Unless otherwise stated in the coupon's description, coupons are only for the first time payment. If you have received a coupon code from another website advertised as a recurred cost, but is intended for first time payments, we are at no obligation to deliver a recurred subscription discount.

2.3 You understand and accept that abuse of the coupon policy will result in the instant termination of your account(s).

 

Refund Policy

Shared Hosting Refund Policy

Customers are offered a 30 day unconditional money back guarantee on all shared hosting plans. This applies to all Basic, Pro, Webmaster, Drupal, Wordpress and Forum shared hosting plans where you will be sharing the same server with other customers.

Ascii Altar offers a unique 30 day consecutive refund policy for shared hosting plans. If you are on any of our shared hosting plans for any number of billing cycles, you are always entitled to your last month's payment if you decide to cancel your hosting subscription. This means that if you have been on our hosting for 6 months, you are entitled to the last month's payment if you decide to cancel your hosting plan with Ascii Altar, which means you would have only paid for 5 months hosting and have gotten your last month's hosting free. We do not offer partial refunds because a full refund is more suitable for our clients.

Due to the nature of our refund policy, we cannot issue refunds for downtime. We most often operate within a 99.90% - 99.97% uptime range. If you are dissatisfied with our hosting, you are free to cancel anytime, and are entitled to a full refund of your last month's payment, no questions asked. Uptime for standard hosts tend to be around 97-99%.

Restrictions

Only first time shared hosting accounts are entitled to refunds. If you subscribe to shared hosting after cancelling, that account will not be entitled to a refund.

Dedicated Hosting Refund Policy

Due to the nature of dedicated servers, costs of setup, maintenance, service, all refunds will be left at the sole discretion of Ascii Altar. In most situations, a partial refund may be issued, but still there is no guarantee of refund for any dedicated hosting.

Abuse & Account Termination

Abusing our staff in any manner or through any medium will result in the termination of your account without notice, and without refund. You are required to respect our individual representatives and support staff. If you have a complaint about a specific staff member, you are free to file a complaint, and it will be investigated.

Ascii Altar reserves the right to cancel, suspend, terminate, or otherwise restrict access to any account at any time, with or without notice, and without refund when situations arise where the account holder defaults on payment or abuse is intended towards Ascii Altar.

3. Digital Products / Templates Refund Policy

3.1 Due to the nature of digital products, we do not offer refunds for templates or any other digital product. You are encouraged to research and investigate every digital product prior to purchasing, and in most situations, you will be presented with a description and demo if available.
4. Third Party Products

4.1 We offer through affiliation, contract, partnership, or license, sales of products from third party vendors. This includes, but is not limited to: Template Monster Templates, Private Label Products, Drupal Services, and so on. We are at no obligation to refund you for purchases made for products offered by those vendors. In order to process a refund for third party vendors, you will have to consult the third party vendor's refund policies on their websites.
5. Refund Restrictions

5.1 Only first time accounts will be eligible for subscription based refunds of the same service type (Where type can be hosting, membership, other monthly services, etcetera). If you've already obtained a refund from a previous subscription of one type, you no longer qualify for future refunds for a product of the same type.
5.2 For some products and services, we cannot offer refunds. This includes, but is not limited to dedicated hosting plans, hands on services (Drupal services, website maintenance, upgrades, custom services), administrative fees, custom install fees, domain name purchases, and services that have begun a new monthly cycle in which the new cycle is eligible for a refund and the old cycle has passed.

5.3 All products and services without an implied refund policy will be left at the discretion of Ascii Altar should a refund be requested.

5.4 If you've paid for any products or services with the following payment methods: Money Order, Bank Wire, or Western Union, we cannot issue refunds in the same format.

5.5 We do not offer credit to accounts as refunds in some situations. Instead, refunds will be issued in one of two methods, Check or Paypal. Refunds will be processed within 14 business days.

5.6 Abuse of our refund policies will automatically void and waive all refunds.

5.7 Violation of any Terms, Policies, User Conduct, etcetera will void and waive all refunds.

5. Binding Arbitration

By using any Ascii Altar service, you agree to submit to binding arbitration. If any disputes or claims arise against Ascii Altar or its subsidiaries, its agents, its employees, its officers, or its owners, such disputes will be handled by an arbitrator of Ascii Altar's choosing. An arbitrator from the American Arbitration Association or the National Arbitration Forum will be selected in the state of Pennsylvania. Arbitrators shall be attorneys or retired judges and shall be selected pursuant to the applicable rules. All decisions rendered by the arbitrator will be binding and final. The arbitrator's award is final and binding on all parties. The Federal Arbitration Act, and not any state arbitration law, governs all arbitration under this Arbitration Clause.
7. Law Enforcement & Disclosure

Ascii Altar will cooperate with any law enforcement officials, and any inquiries regarding any subscribers will be sent to law enforcement upon request. Proof of official law enforcement status is required to request information of our clients.

Ascii Altar shall not be responsible for any damages you or your business may suffer. Ascii Altar makes no warranties of any kind, expressed or implied for services we provide. Ascii Altar disclaims any warranty or merchantability or fitness for a particular purpose. Since we use the public internet for delivery of service, we cannot guarantee uptime or availability of service. Regardless of any situation, we will do our best to ensure the maximum uptime and availability of our services.

 

Indemnification

You agree to indemnify and hold Ascii Altar, its parents, subsidiaries, affiliates, any related companies, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party due to or arising out of

(a). your access to or use of the website,
(b). your violation of the Terms of Service,
(b). the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity,
(d). your violation of local, state and federal laws.

Ascii Altar reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Ascii Altar. Ascii Altar will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

1 Unless you have expressed written permission from Ascii Altar, you do not have the right to use any of Ascii Altar's trade names, trademarks, logos, domain names, service names, service marks, networking sites, or anything that is associated with Ascii Altar whether for profit or non-profit.
2 If you have expressed written permission, you will be given a document outlying your usage permissions. You are required to follow and adhere to those terms set forth in that unique document customized for your usage.

3 The following are methods permissible for using Ascii Altar "Names", "Brand Names", and any references related to Ascii Altar,

(a). Textual links with the title "Ascii Altar" or a fair description of the page being linked to for commentary, reference, or any use within the confines of applicable Fair Use Laws,
(b). Images for purposes of commentary or reference with a link to the source image provided usage falls within the confines of applicable Fair Use Laws,
(c). Any usage that would be within the confines of applicable Fair Use Laws.

4 You acknowledge and understand that Ascii Altar owns all products and services found on the website, unless otherwise noted, or unless otherwise by affiliation, or unless otherwise through license, or unless otherwise through partnership, and all products and services owned by Ascii Altar are to remain the exclusive property of Ascii Altar.
